Terms of Service

These Terms govern your access to and use of Nexus, an AI companion platform operated out of Ontario, Canada. By using the Service you agree to these Terms, the Privacy Policy, and the Rules of Engagement. Read all three.

Section 1

Acceptance

By accessing or using Nexus (the “Service”) you enter a binding legal agreement with Nexus. If you don't agree to these Terms, do not use the Service.

  • Eligibility:You must be 18+ to use Nexus. NSFW content is gated behind tier and per-companion settings — but the platform itself is adults-only.
  • Account:You're responsible for everything that happens on your account, including any companions you create and any messages they generate. Don't share your login.
  • Rules of Engagement:These Terms incorporate the Rules of Engagement by reference. Violating those Rules is a violation of these Terms.
Section 2

The Service

Nexus is an AI companion platform. You build characters, talk to them, generate selfies and short videos, and optionally share them publicly.

  • AI-generated content:Every message a companion sends and every image or video the platform produces is generated by machine-learning models. It's fiction. We do not claim it's factual, true, or representative of any real person.
  • Companion-as-persona:When you create a companion, you grant Nexus a non-exclusive license to host, render, generate, and display content attributed to that companion for the purpose of running the Service.
  • Public content:If you mark a companion or a Story post as public, you grant Nexus the right to display it to other users and in marketing for the Service. Set anything private if you want it kept private.
  • Beta status:Nexus is in open beta. Features may change, break, or disappear. Don't rely on the Service for anything mission-critical.
Section 3

Subscriptions & Billing

  • Plans:Free, Plus ($29.99/mo), and Pro ($54.99/mo) tiers. Each tier has monthly quotas (messages, photos, videos, vision calls) detailed on the Billing page.
  • Auto-renewal:Plus and Pro subscriptions auto-renew monthly via Stripe until you cancel. Cancel anytime from the Billing page — access continues until the end of the paid period.
  • Refunds:All sales are final. Because AI generation has real per-request third-party costs, we don't issue partial refunds on used quota. If you hit a bug that wasted significant quota, email support and we'll credit your account.
  • Price changes:We may change prices with 30 days' notice. Active subscribers keep their grandfathered rate until cancellation.
Section 4

Your Content & IP

  • Ownership:You own what you create on Nexus — your companion definitions, your generated images, your generated videos, your chat history. We don't claim copyright over your output.
  • Our license:You grant Nexus a worldwide, royalty-free license to store, render, transmit, and back up your content for the purpose of operating the Service. This license terminates when you delete the content.
  • Public posts:Anything you post publicly to the Social feed can be viewed by other Nexus users and may be cached or screenshotted. Don't post anything publicly you wouldn't be comfortable with the internet seeing forever.
  • Generated content & third-party rights:You're responsible for ensuring the prompts you submit and the content you generate don't infringe on real people's likeness, copyright, or trademark rights. See the Rules of Engagement.
Section 5

Termination & Suspension

  • Your right to leave:You can delete your account at any time from Settings. Once deleted, your companions, chat history, and posts are permanently removed within 30 days (some backup snapshots may persist up to 90 days for restore purposes).
  • Our right to suspend:We may suspend or permanently ban accounts that violate the Rules of Engagement. The Zero Tolerance categories (CSAM, real-person impersonation, terror content, etc.) result in immediate permanent ban and may be reported to law enforcement.
  • Service termination:If we discontinue Nexus we'll give 30 days' notice and refund any unused subscription days.
Section 6

Disclaimers & Liability

We have to put this section in. Read it. It applies to you.

  • AS-IS:The Service is provided “as-is” and “as-available”. We make no warranty of merchantability, fitness for a particular purpose, or non-infringement. AI outputs are not guaranteed to be accurate, safe, lawful, or coherent.
  • Indirect damages:To the maximum extent permitted by law, Nexus is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Liability cap:Our aggregate liability to you in any 12-month period will not exceed the amount you paid us during that period (or $50, whichever is greater).
  • Force majeure:We're not liable for failures caused by events outside our reasonable control, including third-party API outages, internet failures, natural disasters, or government action.
Section 7

Miscellaneous

  • Changes:We may update these Terms. Material changes trigger a notice in-app and via email. Continued use after the effective date constitutes acceptance.
  • Governing law:These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws principles.
  • Entire agreement:These Terms plus the Privacy Policy plus the Rules of Engagement constitute the entire agreement between you and Nexus.
